Background Of Article 370 &35A

When Maharaja Hari Singh signed a treaty with India in Jammu on October 26, 1947, the treaty did not mention Jammu and Kashmir as a special state but the independence of the state must be preserved.  Was told  At that time, Jammu and Kashmir's  Minister Sheikh Abdullah wanted to have an Article in the Constitution about the status of a particular state.  Chairman of the committee chafing the draft constitution  Ambedkar had refused to make any such article as crude and said that such article would not be suitable for the country.  Four constituencies were reserved for Jammu and Kashmir in the Constituent Assembly. 
On June 16, 1948, Sheikh Abdullah, Mirza Mohammad, Afzal Beg, Maulana Muhammad  and Motiram Bagda joined the draft constitution committee.
   Sheikh Abdullah wents to Ambedkar  on Pandit Jawaharlal Nehru's advice  for recommending a separate constitution, but he refused and said it was not needed.  Dr.  Ambedkar thought that such a separate law for Kashmir would create problems for the rest of the country in the future.
 Later, Sheikh Abdullah  went to Gopalaswamy Aogar, who was then a member of the Constitutional Committee and also a Diwan of Maharaja Hari Singh.  Gopalaswamy also played an important role in the reform of Hari Singh with the Government of India.
 He also disagree with most things about this. He did not even agree to make it to the Constitution.  Threatened.  Meanwhile, Pandit Nehru went on a US tour and Vallabhbhai Patel was asked to submit the resolution to the constitution.  Ashok Kumar Pandey wrote in his book, Kashmirinama: History and Contemporary, "Patel in the Constituent Assembly on October 12 said that taking into account all the problems that the Kashmir government has been facing since birth, we are at the center.  The Constitutional provisions of the State have been specially made.  The number was changed and it was passed in the Constituent Assembly, on which Sheikh Abdullah became angry and because of the circumstances in this sub-section, the present government had relaxed this Article.  There is also a knot on the top - a typhoon market for Jammu and Kashmir - being immovable meant that the future of Kashmir would be decided by it's people. IN this way article 370 & 35A are formed.

This Article allow this state to have its own constitution, own flag and freedom on all matters except foreign, defence and communication areas.
It also gives special right to the residents that only residents can get government jobs in state and no non resident can buy property in the state.
